Terms of Service

Welcome to SHTF (Sudden Hazard Triage Framework). These Terms of Service ("Terms") constitute a legally binding agreement between you and MissionCredible ("Company," "we," "us," or "our") governing your access to and use of the SHTF mobile application ("App"), including any content, functionality, and services offered on or through the App.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the App.

1. Description of Service & Territorial Scope

SHTF provides household surveys, personalized preparedness plans, inventory tracking, and community features.

Geographic Restriction: The App is intended solely for access and use by residents of the United States. We make no representation that the App is appropriate or available for use in other locations. If you access the App from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

2. Account Registration

2.1 Eligibility

You must be at least 18 years old to use the App.

2.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.3 Accurate Information & Third-Party Consent

You agree to provide accurate, current, and complete information during registration and keep it updated.

Representation Regarding Others: If you input data regarding other individuals (such as a spouse, household member, or minor), you represent and warrant that you have obtained their explicit consent (or have legal authority as a parent/guardian) to provide such information to us in accordance with our Privacy Policy.

3. Acceptable Use

You agree not to:

• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm other users
• Upload content that infringes intellectual property rights
• Scrape, data mine, or reverse engineer the App
• Use automated systems to access the App without permission
• Circumvent any security measures

4. User Content

You retain ownership of content you upload but grant us a license to use, display, and distribute it within the App.

You agree that your content will not:

• Violate any law or regulation
• Infringe third-party rights (copyright, trademark, privacy)
• Contain harmful, offensive, or inappropriate material
• Promote violence, discrimination, or illegal activities

We reserve the right to remove content that violates these Terms without notice.

5. Creator Content and Tipping

5.1 Creator Content

Creator content is provided by third-party contributors. We do not endorse or guarantee the accuracy of creator content.

5.2 Tips

• Tips to creators are voluntary and non-refundable
• Tips are processed by Stripe; you agree to Stripe's terms of service
• We charge a platform fee on tips (displayed at checkout)
• Tips are not tax-deductible donations

6. Disclaimer of Warranties

THE APP AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PRODUCTS AVAILABLE THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MISSIONCREDIBLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES: All implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
• Fitness for Purpose: All recommendations, suggestions, and information are for general educational purposes only and do NOT constitute professional emergency management, medical, legal, or any other professional advice. The term "Triage" in our name refers strictly to the logistical prioritization of supplies, not clinical medical triage.
• Accuracy and Completeness: We make NO representations or warranties regarding the accuracy, completeness, reliability, currentness, or timeliness of any content, including but not limited to AI-generated recommendations, weather data, emergency alerts, or user-generated content
• Availability and Performance: We do NOT guarantee that the App will be uninterrupted, timely, secure, error-free, or available at any particular time or location
• Third-Party Content: We are NOT responsible for and make NO warranties regarding any content created by third-party contributors, creators, or users
• Results: We make NO guarantees regarding the results that may be obtained from using the App or the accuracy of any information obtained through the App

6.1 Emergency Situations - Critical Warning

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NO LIABILITY FOR DAMAGES: IN NO EVENT SHALL MISSIONCREDIBLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER MISSIONCREDIBLE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
• MAXIMUM LIABILITY CAP: OUR TOTAL CUMULATIVE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD)
• SPECIFIC EXCLUSIONS: WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY DAMAGES, HARM, INJURY, DEATH, OR LOSSES ARISING FROM OR RELATED TO:
  • Your reliance on any information, recommendations, or content provided through the App during emergency or non-emergency situations
  • Any decisions made or actions taken based on App content
  • Content, actions, or omissions of third-party content creators or users
  • Service interruptions, outages, or data loss for any reason
  • Unauthorized access to your account or personal information
  • Errors, inaccuracies, or omissions in AI-generated content or recommendations
  • Any failure of the App to perform during an actual emergency
• JURISDICTIONAL LIMITATIONS: Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights

8. Indemnification

You agree to indemnify, defend, and hold harmless MissionCredible and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your access to or use of the App
• Your violation of these Terms or any applicable law or regulation
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any content you upload, post, or share through the App
• Any actions taken by you based on information or content obtained through the App
• Any claim that your use of the App caused damage to a third party

This indemnification obligation shall survive the termination of these Terms and your use of the App.

9. Intellectual Property

9.1 Our Property

The App, including its design, features, code, and content (excluding user content), is owned by MissionCredible and protected by intellectual property laws.

9.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Create derivative works
• Reverse engineer or decompile the App
• Remove any proprietary notices

10. Termination

10.1 By You

You may delete your account at any time through the App settings.

10.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior

10.3 Effect of Termination

Upon termination:

• Your right to use the App ends immediately
• We will delete your data in accordance with our Privacy Policy
• Provisions that should survive (limitations, disclaimers, indemnification) will continue

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal dispute, contact us at [email protected]. We will attempt to resolve the issue informally within 30 days.

11.2 Arbitration

Any disputes not resolved informally will be settled by binding arbitration under the rules of the American Arbitration Association. Arbitration will be conducted in Wilmington, Georgia (or via remote teleconference), unless otherwise agreed.

11.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration.

11.4 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through:

• In-app notification
• Email to your registered address
• Updated "Last Updated" date

Continued use after changes constitutes acceptance of the new Terms.

14. General Provisions

Provision	Description
Entire Agreement	These Terms, together with the Privacy Policy, constitute the entire agreement between you and MissionCredible
Severability	If any provision is found unenforceable, the remaining provisions will continue in effect
Waiver	Our failure to enforce any right does not waive that right
Assignment	You may not assign your rights under these Terms. We may assign our rights to a successor entity

ACKNOWLEDGMENT AND ACCEPTANCE: BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SHTF APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE IN THEIR ENTIRETY, UNDERSTAND THEM, AND AGREE TO BE LEGALLY BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND MISSIONCREDIBLE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
